Terms and Conditions of Sale

These Terms and Conditions of Sale govern the sale of artworks offered on www.meganelikin.com. By placing an order, the buyer acknowledges having read and accepted these Terms and Conditions without reservation.
1. Purpose
These Terms and Conditions define the rights and obligations of Mégane Likin and the purchaser in relation to the sale of artworks offered on this website.
2. The Artworks
Unless otherwise stated, all artworks offered for sale are original creations by Mégane Likin.
As each artwork is handmade, slight variations in texture, finish, material, or dimensions are an inherent part of the artistic process and shall not be considered defects.
3. Dimensions
The dimensions provided on the website are for guidance only. Due to the handmade nature of the artworks, slight variations of a few millimetres may occur.
4. Photographs
Every effort is made to ensure that photographs accurately represent the colours, textures, and details of each artwork.
However, slight variations in colour may occur depending on your screen settings and display calibration.
5. Availability
All purchase requests are subject to confirmation of the artwork's availability.
Unless otherwise stated, any quotation or price offer remains valid for fourteen (14) calendar days from the date it is issued. After this period, the offer automatically expires.
An artwork shall only be considered reserved once the order has been confirmed by Mégane Likin and in accordance with the payment terms set out in Article 8.
If a reserved artwork remains on display before being delivered to the purchaser, it shall remain under the custody of Mégane Likin until it is removed from the exhibition. Should the artwork be lost, stolen, destroyed, or damaged to such an extent that it can no longer be sold before delivery, the sale shall automatically be cancelled. Any amounts already paid by the purchaser, including any deposit, will be refunded in full, without any further compensation being due.
6. Refusal of Sale
Mégane Likin reserves the right to refuse or cancel any order before its final confirmation, including, but not limited to, cases of artwork unavailability, obvious pricing or description errors, suspected fraud, or any other legitimate circumstance preventing the completion of the sale.
7. Prices
All prices are stated in euros (€), VAT included.
Shipping costs are not included in the artwork price. They are calculated according to the destination, the artwork's dimensions, and the selected shipping method, and are communicated to the purchaser before the order is confirmed.
Unless otherwise agreed, purchasers residing in Belgium are invited to collect their artwork(s) from Mégane Likin's studio in Auderghem (Brussels), by appointment. The exact address of the studio will be provided upon confirmation of the order.
The applicable price for an artwork or a group of artworks is the price communicated to and accepted by both parties at the time the order is confirmed.
Unless otherwise stated, any price quotation remains valid for fourteen (14) calendar days from the date it is communicated. After this period, the offer expires and Mégane Likin reserves the right to modify the price or the terms of sale.
8. Payment
An invoice is issued before any artwork is collected or shipped.
The applicable payment terms are specified to the purchaser upon confirmation of the order and depend on the nature of the sale.

Immediately available artwork: an invoice for one hundred percent (100%) of the purchase price will be issued. Full payment is required before the artwork is collected or shipped.

Reservation of an artwork currently on display or temporarily unavailable: a deposit corresponding to fifty percent (50%) of the purchase price is required to confirm the reservation and remove the artwork from sale. The remaining balance will be invoiced separately and must be paid before the artwork is collected or shipped.

Commissioned artwork: a deposit corresponding to fifty percent (50%) of the purchase price is required before work begins. The remaining balance will be invoiced separately and must be paid before the artwork is delivered or shipped.
The payment terms applicable to each sale are specified in the quotation, invoice, or order confirmation email sent to the purchaser.
No artwork will be collected or shipped until full payment has been received and confirmed.
All payments must be made in euros (€).
Except where mandatory legal provisions apply or where Mégane Likin is at fault, any sums paid after confirmation of the order are non-refundable.
Ownership of the artwork remains with Mégane Likin until full payment has been received.
9. Shipping and Delivery
Every artwork is carefully packaged to ensure maximum protection during transport.
Shipping arrangements are determined according to the destination of the artwork and the carrier selected.
Shipping costs are the responsibility of the purchaser. They are calculated according to the destination, the dimensions and weight of the artwork, its packaging requirements, and the carrier's applicable rates.
Where shipment is postponed, particularly in the case of an artwork that is on display, temporarily unavailable, or commissioned, any shipping costs communicated at the time of reservation are provided as an estimate only. The final shipping costs will be recalculated before dispatch based on the carrier's rates in force at that time.
Payment of the deposit confirms the purchaser's acceptance of this principle. Any change in shipping costs between the reservation date and the shipment date shall not, in itself, constitute grounds for cancelling the reservation or requesting a refund of the deposit, without prejudice to any mandatory legal rights.
Where an artwork has been reserved while on exhibition, collection or shipment can only take place after the exhibition has closed, the artwork has been returned to Mégane Likin's studio, and all necessary preparation has been completed (including inspection, packaging, and shipping arrangements).
The purchaser will be informed of the estimated shipping date as soon as it can reasonably be confirmed. This date is provided for guidance only and may change, particularly if the exhibition is extended or due to any other circumstance beyond the reasonable control of Mégane Likin.
Delivery times are provided as estimates only and may vary depending on transport conditions.
Any customs duties, import taxes, or other charges imposed by the destination country are the sole responsibility of the purchaser.
The risk of loss or damage to the artwork passes to the purchaser upon delivery, in accordance with the applicable legal provisions.
10. Receipt of the Artwork
The purchaser is invited to inspect the package immediately upon delivery.
If any visible damage is observed, the purchaser must contact Mégane Likin within twenty-four (24) hours of delivery and provide photographs of the packaging, the artwork, the shipping label, and any visible damage.
Upon receipt of this information, a claim will be submitted to the carrier. Any compensation, repair, or replacement will depend on the carrier's decision and the applicable insurance or liability provisions.
11. Returns and Exchanges
Due to the unique nature of the original artworks and the specific circumstances of each sale, all sales are considered final.
No returns, exchanges, or refunds will be accepted once the order has been confirmed and paid for, except in the event of a delivery error, a defect for which Mégane Likin is legally responsible, or where the purchaser benefits from a non-waivable right under applicable law.
12. Commissioned Artworks
Any request for a commissioned artwork is subject to prior consultation between Mégane Likin and the purchaser in order to define the project's characteristics, including its dimensions, format, colour palette, estimated completion time, and price.
Work on the commissioned artwork will only begin once the quotation has been accepted and a deposit corresponding to fifty percent (50%) of the purchase price has been received.
Due to the bespoke nature of commissioned artworks, no substantial modifications may be requested once the creation process has begun, unless expressly agreed by Mégane Likin.
The remaining balance must be paid in full before the artwork is collected or shipped.
Each commissioned artwork remains an original creation by Mégane Likin. The purchaser acknowledges that the artist retains full artistic freedom and creative interpretation, while respecting the characteristics agreed upon by both parties.
Except where mandatory legal provisions apply or where Mégane Likin is at fault, deposits paid for commissioned artworks are non-refundable.
13. Certificate of Authenticity
Each original artwork is accompanied by a Certificate of Authenticity signed by the artist.
The Certificate of Authenticity forms an integral part of the artwork and should be carefully retained by the purchaser.
14. Intellectual Property
The purchase of an artwork transfers ownership of the physical artwork only.
All intellectual property rights, including copyright, remain the exclusive property of Mégane Likin.
No reproduction, representation, publication, distribution, adaptation, modification, commercial exploitation, or other use of the artwork or its image, in whole or in part and in any form whatsoever, is permitted without the prior written consent of Mégane Likin.
15. Force Majeure
Mégane Likin shall not be held liable for any delay or failure to fulfil her contractual obligations where such delay or failure results from an event of force majeure or any circumstance beyond her reasonable control.
16. Governing Law
These Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of Belgium.
In the event of any dispute, the parties agree to make every reasonable effort to reach an amicable settlement before initiating legal proceedings.
Failing such settlement, the Belgian courts shall have exclusive jurisdiction.
